Solvor offers this website, including all information, tools, products, Solvor cards, Solvor Links, account features, uploaded content features, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site, purchasing something from us, uploading content, creating or editing a Solvor Link, tapping or accessing a Solvor card, or otherwise using our Services, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, customers, recipients, account holders, merchants, vendors, and/or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Solvor products may include physical cards, NFC-enabled cards, digital Solvor Links, uploaded customer content, custom messages, photos, links, music links, video links, and other personalized features.

We have made every effort to display as accurately as possible the colors, images, materials, and appearance of our products that appear at the store. We cannot guarantee that your computer monitor's or device screen's display of any color, image, or product appearance will be accurate.

We do not guarantee that all phones, devices, cases, operating systems, settings, or third-party apps will interact with NFC features in the same way. NFC performance may depend on the device, settings, card placement, internet connection, browser, and other factors outside our control.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product or Service at any time. Any offer for any product or Service made on this site is void where prohibited.

We do not warrant that the quality of any products, Services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion. You should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We are not liable for any harm or damages related to the purchase, access, use, or reliance on goods, services, resources, content, or any other transactions made in connection with third-party websites or links. In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site, Solvor Links, Solvor cards, uploaded content features, or any content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in unlawful acts; (c) to violate any international, federal, state, provincial, or local laws, regulations, rules, or ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to violate another person’s privacy, publicity, image, likeness, or personal rights; (f) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, threaten, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, disability, or any protected characteristic; (g) to submit false or misleading information; (h) to upload, link, or transmit viruses or any other type of malicious code; (i) to collect, scrape, track, or misuse the personal information of others; (j) to spam, phish, pharm, pretext, spider, crawl, scrape, or engage in automated abuse; (k) for any obscene, sexually explicit, exploitative, hateful, violent, or immoral purpose; (l) to interfere with or circumvent the security features of the Service, accounts, Solvor Links, edit links, storage systems, or any related website; or (m) to upload content that you do not have permission to use or share.

SECTION 13 - USER UPLOADED CONTENT AND SOLVOR LINKS

When you upload or provide photos, images, messages, links, titles, text, music links, video links, designs, or other content for a Solvor product or Solvor Link, you represent and warrant that you own or have all necessary rights, licenses, permissions, and consents to use, upload, share, display, and provide that content to us for use with the Services.

You are solely responsible for all content you upload, provide, link, display, or share through the Services. Solvor does not guarantee that we will monitor, review, approve, or verify user-provided content before it is processed, stored, displayed, or made accessible.

You grant Solvor a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify for formatting or technical purposes, display, transmit, and otherwise use your uploaded content solely as needed to provide, operate, support, improve, secure, and fulfill the Services, including creating, displaying, editing, and maintaining Solvor Links and related order/account features.

Solvor Links may be viewable by anyone with access to the link or anyone who taps the Solvor card. You should not upload private, sensitive, confidential, or highly personal content unless you are comfortable with it being viewed by others who have access to the Solvor Link or Solvor card.

You agree not to upload or provide content that is illegal, harmful, abusive, hateful, obscene, sexually explicit, exploitative, threatening, defamatory, infringing, misleading, or that violates another person’s privacy, publicity, intellectual property, or other rights.

Solvor may refuse, remove, disable, restrict, archive, or limit access to any Solvor Link or user-provided content if we believe, in our sole discretion, that it violates these Terms, applicable law, platform rules, our policies, or the rights or safety of others.

You understand that deleting, changing, or removing content may affect how your Solvor Link or Solvor card functions.

SECTION 14 - ACCOUNT ACCESS, CLAIM LINKS, AND EDIT LINKS

Certain Solvor products may require account creation, sign-in, order claiming, email verification, or access through a claim link or edit link.

You are responsible for keeping your account, email, claim link, edit link, edit token, and device secure. Anyone with access to your email, account, claim link, edit link, Solvor card, or Solvor Link may be able to access or view certain content.

We may use your email address, Shopify order information, claim tokens, authentication tools, or other verification methods to connect your order to your Solvor account. We are not responsible for unauthorized access caused by your failure to secure your email, account, link, device, or credentials.

SECTION 15 - HOSTING, STORAGE, AND AVAILABILITY

Solvor Links, uploaded content, account data, and related Services may be hosted, stored, processed, or delivered using third-party providers. We use reasonable efforts to maintain the Services, but we do not guarantee that the Services, Solvor Links, uploaded files, NFC functionality, account access, or third-party integrations will be uninterrupted, secure, error-free, or always available.

We may temporarily or permanently modify, restrict, suspend, archive, remove, or discontinue any part of the Services for maintenance, security, legal, operational, or business reasons.

We are not responsible for outages, delays, data loss, broken links, third-party service failures, device limitations, internet issues, user error, or circumstances outside our reasonable control.

SECTION 16 - COPYRIGHT AND INTELLECTUAL PROPERTY

You represent and warrant that any materials, photos, designs, links, messages, or content provided to us for custom orders or Solvor Links do not infringe on the copyright, trademark, privacy, publicity, intellectual property, or other rights of any third party. You agree to indemnify and hold Solvor harmless from any claims arising out of any such infringement or violation.

You agree to comply with all applicable laws and regulations, including copyright and intellectual property laws, when using our Services and submitting content. Solvor reserves the right to refuse service, remove content, or restrict access if any content appears to violate any laws, regulations, rights, or these Terms.

All Solvor names, designs, branding, logos, product concepts, website content, page designs, text, graphics, and other materials provided by Solvor are owned by or licensed to Solvor and may not be copied, reproduced, distributed, modified, or used without our permission, except as allowed by law.

SECTION 17 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent, or warrant that your use of the Service will be uninterrupted, timely, secure, accurate, or error-free.

We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.

You agree that from time to time we may remove, restrict, suspend, archive, or cancel the Service, or any part of the Service, for indefinite periods of time or cancel the Service at any time, without notice to you.

In no case shall Solvor, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, hosting providers, storage providers, payment processors, shipping providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, loss of uploaded content, replacement costs, business interruption, emotional distress, or any similar damages, whether based in contract, tort, negligence, strict liability, or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product.

This includes, but is not limited to, any errors or omissions in content, any loss or damage of any kind incurred as a result of the use of the Service or any content posted, transmitted, uploaded, stored, displayed, linked, or otherwise made available via the Service, even if advised of their possibility.

You agree to indemnify, defend, and hold harmless Solvor and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, your violation of any law, your violation of the rights of a third party, your uploaded content, your Solvor Link content, your misuse of the Services, or your failure to obtain rights or permission for content you provide.

SECTION 19 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 20 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or by ceasing to use our site and Services.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. Solvor is not affiliated with, endorsed by, sponsored by, or in any way connected to any shortcuts apps, music platforms, video platforms, social media platforms, or other third-party applications unless expressly stated by us. Any use of such terms, links, references, icons, or functionalities on our website or in our Services does not imply a partnership, sponsorship, or endorsement.
